The officer shot 25-year-old Jerome Damon on Sept. 3, 2016 in the area near Caesars Atlantic City.

ATLANTIC CITY -- A grand jury declined to bring indictments against an Atlantic City police officer involved in the fatal shooting of a 25-year-old man, the Atlantic County prosecutor's office said on Wednesday.

According to the statement, the grand jury said the unnamed officer acted lawfully for shooting and killing a man after observing an armed robbery last fall.

On Sept. 3, 2016, two officers were patrolling the area near Caesars Atlantic City when they came across an armed robbery involving six males who all fled the scene.

One of the officers was shot and critically injured, but the other officer fired back and hit one of the suspects, who was found deceased about two blocks away.

He was identified as Jerome Damon, of Camden.

Damon died from a single gunshot wound to the upper right back, according to an autopsy.

The investigation revealed that Damon and two of the other males were attempting to rob the other three individuals.

Police gathered statements from the victims and independent witnesses, along with collected surveillance footage from the area -- showing the shooting of the first officer -- which was presented to the grand jury as evidence.

The two other suspects, Martel Chisholm, 30, of Pleasantville, and Demetris Cross, 28, of Bridgeton, were arrested and face two counts of attempted murder, robbery, conspiracy and weapons charges.

Their charges are awaiting review by a different grand jury panel.
