Dead N.J. toddler's aunt heard by grand jury, report says

It's been more than a month since 3-year-old Brendan Creato was found dead near the Cooper River.

HADDON TWP. -- The 20-year-old aunt of Brendan Creato, the toddler found dead near Cooper River more than one month ago, was subpoenaed by a grand jury in connection with the mysterious death, according to NBC10.

Philadelphia-based attorney William Brennan -- who is representing David and Lisa Creato, the grandparents of the child, as well as the child's aunt, Sarah Jessica -- was not immediately available for comment Thursday morning. NBC10 reported that Sarah testified Monday.

"It's really adding insult to injury to have any negative inference pointed at my clients' direction when they are going through a terrible period of personal tragedy and loss," Brennan told NJ Advance Media earlier this month regarding the lack of updates from investigators.

When contacted by NBC10, Brennan declined to confirm or deny Sarah Creato's testimony as part of the confidential proceedings. A grand jury works with a prosecutor to determine whether or not to indict or charge someone.

Brendan Creato was found dead on the morning of Oct. 13 after being reported missing at around 6 a.m. by his father, DJ Creato. The boy's mother, Samantha Denato, does not live at the same residence.

A video created by Sarah Creato as part of a school project reportedly portrayed Brendan as a toddler who goes missing and is later found dead. Brennan dismissed the video as an "uncanny coincidence," when he spoke with NBC10. Camden County College, which Sarah Creato listed as her school on her Facebook page, did not return a request for comment regarding the video in question.

Sarah Creato's social media accounts appear to show her and Brendan on numerous outings together, playing with toys, reading a book and posing at the Camden waterfront with the Philadelphia skyline in the background. The last picture to feature Brendan was taken six weeks ago.

An autopsy failed to reveal the cause or manner of the toddler's death. Toxicology tests, used to find traces of drugs or chemicals in the body, also came back negative.

"Unfortunately it's an answer that just brings up more questions," lawyer Richard J. Fuschino Jr., who is representing DJ Creato, said.

The Camden County Prosecutor's Office has said that an official update will be released when warranted.

So far, the office has said that there were no signs of forced entry at DJ Creato's apartment, which is about a half-mile from where the boy's body was found, and that Brendan had not been sexually abused. The office previously declined to comment on reports of a man seen pushing a baby carriage near the scene that morning.

"They're anxious to get some answers as to what caused this to happen," Brennan said earlier this month of Brendan's grandparents, David and Lisa Creato. "It's frustrating that when there's news of any sort, especially a negative toxicology report, that I wouldn't hear it from the prosecutor, who assured me and my clients that we wouldn't find out about these things in the media."
